4 / FORMATION OF THE CONTRACT
These general conditions may be modified or supplemented when Advenced Solutions Finance establishes an order form or an estimate which then constitute the special conditions. OFFERS AND QUOTES – RATES
Our offers and quotes are valid for 1 month, starting on the day they are sent, unless specifically mentioned on the DevisAdvenced Solutions Finance. The figures included in our offers, quotes or order forms are only binding with regard to Advenced Financial Solutions insofar as the client does not make any changes to the reference project. The conditions of the offer relate exclusively to the services specified in the contractual elements.
Any additional service not provided for on the latter will be subject to an increase equivalent to its value. Any urgent work may be subject to a price increase.
The price of the service is firm. It is stipulated excluding taxes and expressed in dirhams relating to the total amount to be paid.
The prices of our products are expressed in Moroccan Dirham or in Euro excluding processing, shipping, transport and delivery costs which are invoiced in addition (see delivery paragraph).
Regarding orders invoiced in Morocco, prices are indicated inclusive of all taxes. The prices take into account the VAT applicable on the day of the order. Any change in the applicable rate will be reflected in the prices of the products.
The applicable tariffs are listed on the site http://www.asfgroups.com where they can be freely consulted. Advenced Solutions Finance reserves the right to modify its prices at any time without notice.
Promotions mentioned on the site http://www.asfgroups.com may be implemented for a strictly limited period.
The products will be invoiced on the basis of the rates in effect at the time of the order entry. The products remain the property of Advenced Solutions Finance until full payment of the price by Advenced Solutions Finance.
ORDERED
The contractual information is presented in French and will be the subject of a confirmation of reading and acceptance without reservation, even before proceeding to the payment of the order.
The contract is concluded only in the event of an order confirmation by Advenced Solutions Finance. Advenced Solutions Finance reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or which would present in his eyes any form of risk.
Any order implies acceptance of the prices and description of the products available for sale. Advenced Solutions Finance undertakes to honor orders received on the website only within the limits of available stocks of the products. In the absence of availability of one or more product (s) ordered, Advenced Solutions Finance undertakes to inform the customer as soon as possible.

Any order concerning the provision of service gives rise to the prior payment of a deposit of 50%, unless specified in the quote or order form. The realization of said order begins as soon as this deposit has been received. The payment of the deposit (or of the entire order) does not, however, authorize the CLIENT’s access to any form of ownership over all or part of the elements of the service which remains the exclusive property of Advenced Solutions Finance. , unless specifically stated otherwise.
In the event of non-payment before the anniversary date, and 5 days of no response following email reminders, the contract will be automatically terminated.In the event of default or delay in total or partial payment of the price of the service:
• the CLIENT will have to pay a late payment penalty equivalent to one and a half times the legal interest rate. The legal interest rate is that in force on the day the deficiency was noted. The penalty is calculated on the amount excluding tax of the amount remaining due, and runs from the due date of the payment. All services sold may be suspended in the event of default or late payment. After formal notice by mail with request for acknowledgment of receipt, the sale can be automatically terminated in favor of Advenced Solutions Finance, the resolution taking effect two weeks after the sending of a formal notice that has remained unsuccessful. In this situation, Advenced Solutions Finance is entitled to stop the services sold, to claim the return of the service or its compensation, the deposits received remaining acquired. Any dispute or complaint relating to invoicing must be sent by Email with acknowledgment of receipt or registered letter within ten days of receipt of the said invoice, failing which Advenced Solutions Finance no longer accepts any complaints.
Payment
The customer has five payment methods to pay for his purchases: payment by credit card, bank transfer, payment by cash deposit in a bank branch, payment on delivery (cash on delivery) and payment by check bank certified. These five payment methods are governed by Moroccan laws and any attempt at fraud is severely punished by the laws in force.
In the case of payment by credit card, the transaction is remitted for debit from your account within the day following the date of the delivery confirmation.
Your multichannel payments are secured by the Center Monétique Interbancaire (CMI) which offers a fully secure payment service. The Consumer guarantees to the Company Advenced Solutions Finance that he has the necessary authorizations to use the payment method chosen by him, when validating his order.
In the event of payment by bank card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the card issuer between the Company Advenced Solutions Finance and its banking establishment apply.
This payment can be made by a Moroccan or foreign bank card. The user’s personal data is encrypted during the transaction on the platform to guarantee the strictest confidentiality.
The customer is therefore required to communicate truthful and proven information, any false information is considered fraudulent and could lead to the cancellation of the order and be subject to legal proceedings. In addition, he guarantees to the site that he has the necessary authorizations to use this method of payment.
The credit card payment system is certified by CMI, VISA, MasterCard and all Moroccan banks.
In the event of payment by bank card, the customer may be asked for supporting documents in order to verify his identity and to prevent any attempt at fraud.
The payment by bank transfer does not allow to reserve the products. The order is only validated after receipt of payment. Beyond a period of 15 days, if Advenced Solutions Finance does not receive a transfer to the Advenced Solutions Finance account, the order is canceled. The customer should take into consideration that a wire transfer requires at least 48 hours for the money to be transferred from one account to another.
For practical reasons, the user must indicate the number of his order by reference to his transfer. The validation of an order paid by bank transfer is only done after receipt of the latter.
It is advisable to mention the reference of the order when depositing cash with the bank.
Validation is only done after receipt of payment, after which the merchandise is shipped to its buyer.
Any order with cash on delivery payment is carefully checked by Advenced Solutions Finance’s fraud control service, so this requires processing time before validation. Once validated, it is sent to the customer who must pay the amount of his purchases in cash to the postman. In case of refusal of payment on the part of the customer, the company reserves the right to sue him.Payment by check on delivery is accepted provided it is certified by the customer’s bank. The check in question should be made payable to Advenced Solutions Finance.
It is advisable to mention the order reference on the back of the check.
It may take time to process orders paid by check. Indeed, once the order has been made, the customer must send us, by email or fax, a copy of the certified check.
Once this copy is received, the order is validated, then shipped as soon as possible. The check must be given to the driver at the time of delivery.
Note that the products of the order can only be reserved from the moment of receipt of the copy of the check, and the original

6.1 Unless expressly stipulated otherwise, delivery, regardless of the service, is made to the Advenced Solutions Finance sales office, without any particular formalities. Unless there is an agreement between Advenced Solutions Finance and the CUSTOMER to determine the expected delivery date and formalized by an e-mail on delivery of the project, delivery is deemed to have taken place on the dates and conditions provided.
If during the delivery of the service, the CUSTOMER considers that the service does not comply with the order, he must within a period of two weeks from the delivery, declare in writing the malfunction of the defects that he attributes to the service, and provide any justification as to the reality thereof. In any case, the guarantee of a service only concerns the elements mentioned in the contractual elements. In particular, in the event of a complaint concerning an essentially intangible service (management solution, business application, etc.), the specifications remain the reference document to which both parties must refer to assess whether the service complies with the specificities of the project. Only the elements mentioned in this document are considered as falling under the obligations of Advenced Solutions Finance.
6.2 No delivery time is guaranteed, unless it is expressly stipulated on the order form. Even in this case, Advenced Solutions Financen does not incur any responsibility if any delay is attributable to suppliers, the customer or other third parties, whether or not it is force majeure. Deadlines do not start to run until Advenced Solutions Finance is in possession of all the information, documents and supports necessary for the proper performance of the work.
6.3 The delivery costs (material, product, etc.) include the costs of processing, packaging. Transport costs are charged to the customer. Advenced Solutions Finance can not be held responsible for errors in the address provided by the customer. Any merchandise returned to Advenced Solutions Finance for this reason will give rise to the customer’s choice either to reimbursement of the order, delivery costs remaining acquired to Advenced Solutions Finance, or to reshipment to the customer who will then take charge of the costs in advance. re-shipment costs. Delivery is deemed to have been made upon delivery by the carrier of the products ordered by the customer. The customer is required to check the condition of the products delivered. Advenced Solutions Finance cannot be held liable for delivery times in the event of specific external events (strikes, natural disasters, etc.).
6.4Availability: Information on the availability of products is provided to the customer when placing the order. In the event of unavailability of a product after placing the order, Advenced Solutions Finance undertakes to inform the customer by email or by post as soon as possible. The customer’s order will be automatically canceled and the corresponding amount refunded.
7 / EXCHANGE, RETURN AND REFUND
Right to retract
By law, the customer has a withdrawal period of 7 days from the day of receipt of the package. To this end, each customer is required to communicate to us by email the same day the date of receipt of said package, if applicable, we will consider that it was received 2 days after the date of shipment.
When the seven-day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.
However, this right of withdrawal is subject to certain conditions:
– The product must not have been opened or unpacked, it must be intact as it was sent, otherwise it is no longer refundable.
– The shipping and return costs are the responsibility of the customer.
– In the case of payment by credit card, processing fees are deducted from the amount to be reimbursed, which can reach 2.5% of the amount of the order. Reimbursement is made within a maximum of 15 days.

8 / PROPERTY
All intellectual or industrial property rights, including trademark rights, literary and artistic property rights, in particular reproduction, representation and adaptation rights, rights to software or computer files, rights to the content of the databases, known as “sui-generis rights”, relating to specific developments carried out for the client will remain the property of Advenced Solutions Finance, unless specifically stated otherwise.
9 / REFERENCE TO CUSTOMERS
The Client authorizes Advenced Solutions Finance to mention its name or company name in our commercial documents, as references for the purposes of its own commercial promotion.
The Customer agrees, unless otherwise specified in the quote or Purchase Order, to include the following statement: Produced by Advanced Solutions Finance (or other equivalent wording) or on the legal notices page. Advenced Solutions Finance or its commercial intermediaries are authorized to use the Product for demonstration purposes.
10 / COMMITMENT OF ADVENCED SOLUTIONS FINANCE
10.1 Respect for orders and professional uses. The quote or the order form details the different characteristics of the service offer chosen by the Client. Advenced Solutions Finance makes its resources available in accordance with the elements provided by the Client on the order form or the quote. ” undertakes, as part of an obligation of means, to provide all the care and diligence necessary for the implementation of a quality service in accordance with the practices of the profession and the state of the art .

10.2 Guarantee: Advenced Solutions Finance undertakes to remedy any operating defect resulting from a defect in material, manufacture or design, during a period of one month, following the delivery of the project, and except specific mentions in the estimate or purchase order.

This warranty covers labor costs and in general the work resulting from the warranty obligation. These various interventions do not have the consequence of extending the duration of the guarantee. By express agreement, Advenced Solutions Finance’s liability is strictly limited to the obligations thus defined and will not be liable for any compensation of any kind whatsoever, in particular with regard to hidden defects and immaterial damage.
11 / CUSTOMER’S COMMITMENT AND RESPONSIBILITY
The Customer must take charge of and ensure that any authorizations relating to copyright or related rights resulting therefrom are obtained. The Customer undertakes to provide Advenced Solutions Finance with data that is fair, of quality and in accordance with the legislation in force. The Customer undertakes to comply with all the legal and regulatory requirements in force relating to information technology, files and freedoms. It is the customer’s responsibility to call on any competent third party, to validate the correct application of the legal requirements relating to the protection of personal data. The Client undertakes not to hire, hire or employ any member of Advenced Solutions Finance staff who participated in the performance of the work covered by this contract, throughout the duration of this contract and until the expiration of a period. 36 months from the end of the contractual relationship.
12 / CONFIDENTIALITY
Each of the parties to this contract undertakes in its own name and that of its collaborators to consider as confidential, during the term of this contract and after its expiry, the documents, systems, software, know-how coming from the other part of which it may have become aware during the execution of this contract, and not to use them outside the needs of this agreement. Information which has fallen into the public domain or whose disclosure has been authorized in writing by the party concerned is not affected by this confidentiality obligation. The contract may be terminated automatically, without judicial or extrajudicial formality, if one or the other of the parties fails to comply with the obligations stipulated in these or in the Special Conditions or in the Order, and does not remedy this failure within one month. the receipt of a formal notice by registered letter with acknowledgment of receipt or extrajudicial act, without compensation and without prejudice to the sums remaining due and to any damages.
13 / DISPUTES
In the event of difficulties or disagreements between the parties during the interpretation, execution or termination of this agreement, the parties agree to seek an amicable solution in the spirit of this contract.
